Cape Town – A school principal who hugged and tried to forcibly kiss his personal assistant claimed he was only joking with his victim when confronted on WhatsApp.

Nyiko Baloyi, headmaster of Thornridge Secondary School in Pretoria, also blamed stress for his sexual harassment.

He was confronted by the PA mother who watched his dirty act through a half-closed window.

The sexual assault occurred in Baloyi’s office. The victim testified in the arbitration that Baloyi asked her to proofread some letters in the office.

After she finished, Baloyi asked her to hug him, she testified. Baloyi squeezed her so hard she could feel his erection, the referee heard.

He also tried to forcefully kiss her. The woman said she had pulled her face away and asked Baloyi to stop.

Later that day, the PA’s mother confronted Baloyi via WhatsApp.

She stated in the WhatsApp text: “What you are doing is not acceptable the way you (my daughter) have hugged and tried to kiss her.

“I saw you through the window, I was waiting for (her) to say something, but she didn’t. I’m very disappointed, I can’t believe it’s from you (sic) ”.

Baloyi replied that he was only kidding. “I was just kidding her, sorry my sister, I apologize. Think you will find a place in your heart to forgive me. Sometimes when you are stressed you act weird. Will speak tomorrow, please (sic). “

The texts were dismissed in arbitration. The arbitration was commissioned at Baloyi’s behest. He attempted to overturn the Gauteng Education Ministry’s decision in 2020 to fire him.

Baloyi denied that he was referring to sexual plague allegations in his text.

He claimed he apologized for keeping the PA long after its knock-off period.

Baloyi also denied asking for a hug, saying the PA initiated it.

Referee Themba Manganyi noted that Baloyi was trying to mislead him about the context of his WhatsApp text.

“The message from the mother was clear as to why she was disappointed with Baloyi,” said Manganyi. He concluded that the version of Baloyi’s accusers was true and that the division was doing the right thing to eliminate him.

“After determining that the witnesses (from the department) were believable and reliable, and their version was the most likely, I establish that Baloyi was guilty as charged,” Manganyi said.
